The PFA: Protection from Abuse Order.

Postby Bob Sciarrone » Wed Mar 10, 2010 3:54 pm

The PFA wsa instituted by the Commonwealth of PA. for the sole purpose to protect a victim.

The misconceptions of the PFA order is that the Police have the right to arrest the defendant upon viewing the plaintiff and defendant together. This is false and thereby constitutes a false arrest.

The Plaintiff must call 911 to make them aware that a violation exists.

Many Plaintiffs and Defendants aren't aware that they can go to court to have it dismissed and even then, some Judges will act outside their Judicial Capacity to deny it. If both parties agree to the dismissal, the Judge has no right to deny it. If the Judge does, then you can sue the Judge because the immunity is lost. Any Judge that violates his or her oath is a trespasser of the Law and actually could be found guilty of Treason against the State, or United States, Laws and Constitutions.

If you get stopped and the supposed victim refuses to file a complaint, the Police may very well intimidate the victim into filing the complaint against their will.

DO NOT ALLOW THAT TO HAPPEN.

This happened on September 6th 2009 when I was unlawfully arrested by PMRPD. If you remember when I was arrested, I stated that Bashore was in the Office. In that case, there was a PFA in effect and the Police stopped the vehicle for not signaling or something to that effect. Now, this couple was visiting friends and there was no valid complaint made. Bashore mandated an arrest because he knew the girl. I spoke with the guy in Jail and he told me what happened. I told him that Bashore was a dirty cop. I also told him his arrest was not warranted. I gave him my website and have never heard from him again.

So, just because their is a PFA against you does not mean that the POlice can intervene whenever they want to. There must be a complaint. And don't allow them to intimidate you. They have less power than you think. They may be backed up by the DA and Judges but there's a way around that also. I am willing to help anyone out that has an issue of this kind. Especially if Bashore was involved. Please contact me.

In my case, the Criminal Complaint and the Probable Cause statement contradicted themselves which make the Police liable. And to think that when I was sitting in the POlice car with handcuffs on while my kids watched, I saw all three police officers read the criminal complaint my wife filed.

For this and other reasons I state that PMRPD is not a Professional Department and Chief Lewis does not train them to be prudent.

To include, the PFA goes both ways. The victim can not abuse the defendant either,. There is case law on that.

Don't get me wrong, I have about enough faith in the Superior Court as I would about holding my own taking a bottle of castor oil or a package of exlax!

However, it is still case law and if they don't follow it, get in touch with me.
